THIS ONE-YEAR LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER CONSUMER RIGHTS, WHICH VARY FROM STATE TO STATE.

WE WARRANT THAT DURING THE WARRANTY PERIOD, THE PRODUCT WILL BE FREE FROM DEFECTS IN MATERIALS AND WORKMANSHIP.

WE LIMIT THE DURATION AND REMEDIES OF ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

OUR RESPONSIBILITY FOR DEFECTIVE GOODS IS LIMITED TO REPAIR OR REPLACEMENT AS DESCRIBED BELOW IN THIS WARRANTY STATEMENT.

Please note: All claims made under this limited warranty will be governed by the terms set out in this warranty document.

WHO MAY USE THIS WARRANTY?

Warner Bros. Home Entertainment Inc., located at address 4000 Warner Blvd., Burbank, CA 91522 (“we”, “us” or “our”), extends this limited warranty only to the consumer who originally purchased the product or an individual who receives the product from the original purchaser as a gift (collectively, “you”). It does not extend to any subsequent owner or other transferee of the product.

WHAT DOES THIS WARRANTY COVER?

We warrant the Magic Caster Wand contained in the original packaging (the “product”) against defects in materials and workmanship when used in accordance with the product’s user manuals, technical specifications and other published guidelines for the Warranty Period as defined below. In the event of any defect in materials and workmanship, you will be able to direct your claims to us even in situations where you purchased the product from a third party.

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover any damage due to: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions or to perform any preventive maintenance; (e) modifications; (f) unauthorized repair; (g) normal wear and tear or otherwise due to the normal aging of the product; (h) consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (i) cosmetic damage, including, but not limited to, scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (j) damage caused by use with a third party component or product that does not meet our specifications; (k) damage caused by operating the product outside the user manual, the technical specifications or other published guidelines; (l) product that has been modified to alter functionality or capability without our written permission; (m) if we receive information from relevant public authorities that the product has been stolen or if you are unable to deactivate passcode-enabled or other security measures designed to prevent unauthorized access to the product, and you cannot prove in any way that you are the authorized user of the product (e.g., by presenting proof of purchase); or (n) external causes such as accidents, abuse, or other actions or events beyond our reasonable control.

WHAT IS THE PERIOD OF COVERAGE?

This limited warranty starts on the date your product is shipped and lasts for one (1) year (the “Warranty Period”). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

If during the Warranty Period you submit a claim to us in accordance with this warranty, we will, at our sole option:

(i) repair the product using new or previously used genuine parts that have been tested and passed our functional requirements,

(ii) replace the product with a replacement product of the same model (or with your consent a product that has the same or substantially similar features as the original product – e.g., a different model with the same features, or the same model in a different color) that is new or comprised of new and/or previously used genuine parts and has been tested and passed functional requirements, or

(iii) refund the purchase price of the product.

When a product or part is replaced, any replacement item becomes your property and the replaced or refunded item becomes our property.
A replacement part or product or a repaired product assumes the remaining warranty of the original product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you.
We will also pay for shipping and handling fees to return the repaired or replacement product to you if we elect to repair or replace the defective product.


HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, you must go to https://help.harrypottermagiccasterwand.com or email our Customer Service Department at support@harrypottermagiccasterwand.com during the Warranty Period to file a warranty claim. Upon approval of your warranty claim, we will issue you a Defective Merchandise Authorization (“DMA”) number. No warranty service will be provided without a DMA number.

 

LIMITATION OF LIABILITY

Other than the consumer law rights to which you are entitled, all warranties, conditions and other terms not set out in this warranty document are excluded from the limited warranty. Some states and countries do not allow limitations on how long such warranties, conditions and/or implied terms may last, so the limitation described above may not apply to you.

We do not warrant, represent or undertake that it will be able to repair or replace any product under this warranty without risk to and / or loss of information and / or data stored on the product.

In no event shall we be liable for: (i) any losses that were not caused by our breach of this warranty document; (ii) any loss or damage that was not, at the time of your purchase of the product, a reasonably foreseeable consequence of us breaching this warranty document; or (iii) losses relating to any business of yours, loss of profits, loss of data or loss of opportunity. The provisions of this warranty document shall not apply to (i) death or personal injury, (ii) fraud or gross negligence; or (iii) fraudulent misrepresentation; or (iv) any other liability that cannot be limited or excluded as a matter of law.

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE PRODUCT, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

 

GENERAL

This warranty will be interpreted pursuant to the laws of the United States and the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws, unless otherwise prohibited by State law. This warranty is not intended to confer any additional legal, jurisdictional or warranty rights to you other than those set forth herein or required by law. If any term is held to be illegal or unenforceable by force of law, it will be excluded from the warranty and the legality or enforceability of the remaining terms shall not be affected.
